Terms and Conditions

These Terms govern the use of Fanómeno. By creating an account, accessing or using the platform, you accept these Terms in their entirety. If you do not agree, do not use Fanómeno.

Beta version notice. Fanómeno is currently offered in a beta phase. This means that it may contain errors, failures or incomplete features, and that the service, game modes, rules, points, rating, credits, leagues and prices may change, be suspended or be reset. The service is provided "as is" and "as available."

1. What Fanómeno is

Fanómeno is a gamified sports trivia web platform. Users answer questions about matches, players and sporting events that have already taken place or are in progress, earn points for correct answers and speed, climb the rankings, compete against one another and take part in leagues and tournaments.

The platform includes, among others, the following game modes, which may be added, modified or withdrawn at any time:

Live trivia: questions synchronized with a match in progress, with a per-match ranking.
Daily trivia: daily question decks, organized by rounds and topics.
1v1 duels and drafts: head-to-head matches between two users with skill-based matchmaking, including the selection and banning of categories.
Incógnito: deducing the identity of a hidden athlete by asking yes-or-no questions that carry an in-game cost.
Tournaments: bracket-based competitions with matchmaking among participants.
Leagues: private leagues created by users and global leagues operated by Fanómeno, as well as challenges between friends via invitation link.

The sports and competitions covered may vary over time depending on the availability of data and schedules.

Fanómeno is NOT a betting site. It is not a sportsbook, a game of chance, or a sports prediction or forecasting platform. Questions are based on facts that have already occurred or are in progress: what is rewarded is knowledge, deduction and speed, not chance or the forecasting of future results. No money is wagered on the outcome of events.

This applies to all modes, including duels, Incógnito and tournaments: the outcome depends exclusively on the user's performance. Participation does not require payment—play is powered by energy and free games that recharge periodically—and in-game credits and points have no monetary value and cannot be exchanged for money (see sections 8 and 9).

2. Eligibility and age

You must be at least 13 years old to use Fanómeno. Some leagues, prizes or advertising content may be reserved for people over 18 years old; in particular, advertising from the advertiser network is shown only to users over 18. If you are a minor, you represent that you have the consent of your mother, father or guardian. We ask for your date of birth, among other reasons, to apply these age controls and to avoid showing unsuitable advertising or content to minors.

3. Your account

You are responsible for the accuracy of your account information and for keeping your credentials confidential. You are responsible for all activity carried out from your account. Notify us of any unauthorized use.

Each person may have only one account. Creating multiple accounts to obtain competitive advantages or additional rewards, or to manipulate matchmaking, is prohibited and may result in the suspension of all accounts involved.

4. How to play: energy, limits and availability

Game modes may be subject to daily limits, to an energy or free-game system that recharges periodically, and to internal costs expressed in credits. These limits, their amounts and their recharge times are part of the game design and may be modified at any time, especially during the beta phase.

The availability of live trivia depends on the match schedule and on third-party data sources. We do not guarantee coverage of any particular match, competition or season, nor that a session once started can be completed if the event is suspended or rescheduled or if the data source fails.

We make reasonable efforts to ensure that questions and answers are correct, but we do not guarantee the accuracy of the sports data or statistics used. If you detect an error, you may report it; we may correct questions, void results or adjust scores when necessary to preserve the integrity of the competition.

5. Duels, tournaments and fair play

In 1v1 duels and tournaments, participants are matched through automated systems that consider, among other factors, the user's level or rating. By participating, you accept that:

The outcome is determined in accordance with the scoring rules in force (correct answers, speed and, where applicable, tiebreaker criteria) shown on the platform.
Abandoning, disconnecting or failing to answer within the allotted time may count as a loss and affect your rating or your in-game resources.
Collusion between users, sharing answers, playing on behalf of another person, or any arrangement to manipulate results, matchmaking or rankings is prohibited.
The platform's decisions on results, matchmaking, rating adjustments and sanctions are final, without prejudice to your right to file a complaint through the channels indicated in section 20.

6. Rankings, divisions and seasons

Fanómeno maintains rankings and standings by mode, sport, league, geographic scope (city, state, country and global) and period (season and all-time), as well as skill-based divisions assigned according to your performance relative to other users.

Seasons are periodic and reset. When a season closes, season positions, points or ratings may be reset or archived.
Your position, division, points, rating and credits do not constitute a vested right, are not your property, are not transferable and have no monetary value.
We may recalculate, correct or void positions, points and ratings when we detect technical errors, incorrect data, cheating or breaches of these Terms.
The division assignment criteria and thresholds may be adjusted as the user base evolves.

7. User-created leagues

Fanómeno allows businesses, brands, content creators, communities and users to create and manage their own leagues, with their own name, rules, visual customization, content and prizes. Whoever creates a league is solely responsible for it, including its rules, the selection of participants, moderation, the content they upload and the prizes they offer.

Access to a private league may be granted through invitation links or codes. Whoever manages the league is responsible for whom they distribute such access to and for how it is used.

8. Prizes — important point

Each user who places prizes in their leagues is solely responsible for defining, funding and distributing them to the winners.
Fanómeno is NOT responsible for prizes offered in leagues created by users (businesses, brands, creators or others). Fanómeno does not guarantee, deliver or answer for such prizes.
Fanómeno is responsible only for the prizes of its own official leagues, that is, those created and operated directly by Fanómeno and identified as official.
Any claim regarding a prize offered by a league creator must be addressed directly to that creator.

Points, credits, energy, rating or rewards within the platform have no cash value, cannot be exchanged for money and are not transferable between users, unless expressly stated otherwise in an official Fanómeno league or in the rules of a specific promotion.

9. Credits and the in-game economy

The platform uses credits and other virtual resources (such as energy) to access certain features, unlock additional rounds, create leagues or take part in certain modes. With respect to them:

Credits constitute a limited, personal, revocable and non-transferable license of use within the platform; they are not money, are not a deposit and do not accrue interest or create property rights.
Credits may be obtained free of charge through gameplay, login streaks, referrals or by watching rewarded ads, and, where applicable, by purchase within the platform.
We may modify internal costs, the amounts granted and the ways of obtaining them at any time.
Unused credits are not refundable in money and may be lost if the account is deleted, suspended for a breach, or if the service is discontinued, to the extent permitted by applicable law.

10. Payments, plans and subscriptions

Some features are paid: for example, the creation of certain leagues according to their plans, the purchase of credits or a paid subscription with additional benefits within the platform.

Payments are processed through third-party payment providers. Fanómeno does not store your full card details; the processing of that data is also governed by the processor's policies.
Subscriptions renew automatically for equal periods until you cancel them. You may cancel at any time from your account or by writing to us; cancellation takes effect at the end of the period already paid, and you keep access until then.
Displayed prices may change, especially during the beta phase. You will be notified of price changes to an active subscription before they apply.
Unless applicable law or a promotion states otherwise, payments are non-refundable once the league has been activated, the credits have been delivered or the subscription period has begun. This does not limit any non-waivable rights you may have as a consumer.
Non-payment or a declined charge may suspend access to paid features.

11. In-person check-in, codes and location

Some leagues or promotions may require you to confirm your presence at a physical location using QR codes or location verification. In those cases, use of these features is voluntary and requires you to grant the corresponding permissions on your device; if you do not grant them, you may not be able to take part in that specific league or promotion.

Spoofing your location, sharing restricted-access codes or using tools to simulate physical presence constitutes a breach of these Terms. The processing of this data is described in our Privacy Policy.

12. Content uploaded by users (images, logos and materials)

When creating or customizing a league, you may upload images, logos, names, trademarks and other materials ("User Content"). With respect to that content:

Fanómeno is not responsible for the images, logos or other materials that each user uploads for their leagues.
Each user must own, or hold the licenses, authorizations, property rights or third-party copyrights necessary for, all the content they upload. By uploading it, you represent and warrant that you hold those rights.
You are solely responsible for any infringement of copyrights, trademarks, image rights or other third-party rights arising from the content you upload.
You grant Fanómeno a limited license to host and display your content solely for the purpose of operating your league within the platform.
Fanómeno may review, reject or remove any content it considers unlawful, infringing, offensive or contrary to these Terms, without prior notice.

The foregoing also applies to your username, avatar and any text you post on the platform.

If you believe that any content infringes your rights, notify us at legal@point.fanomeno.com and we will address it.

13. Names of competitions, teams and athletes

Fanómeno's questions and game modes refer to sporting facts, competitions, teams and athletes. Such names are used in a purely descriptive and informational manner, to identify the facts that are the subject of the questions.

Fanómeno is not affiliated with, associated with, authorized by or sponsored by any league, federation, club, team or athlete, nor does it suggest any such relationship. All trademarks and names mentioned belong to their respective owners.

14. User conduct

You agree not to: cheat or manipulate points, rating or rankings; use bots, scripts, unauthorized automation or external lookup tools during games; create multiple accounts; collude with other users; impersonate third parties; misrepresent your age or location; post content that is unlawful, offensive or discriminatory, or that promotes betting, alcohol to minors or other prohibited activities; harass other users; breach the security of the platform; mass-extract its content or data; or use Fanómeno for illegal purposes.

A breach may result in the voiding of results and rewards, a rating reset, exclusion from rankings, or the suspension or termination of the account, without refund.

15. Fanómeno's intellectual property

The platform, its software, its "Fanómeno" brand, its design, the trivia engine, the game mechanics and the content provided by Fanómeno are protected by intellectual property rights and belong to Fanómeno or its licensors. You may not copy, modify or exploit them without authorization.

16. Advertising and sponsors

Fanómeno may display ads, sponsored placements, sponsored questions, sponsored leagues and promotions within the platform, targeted by age, sport or league, in a safe environment. Advertising from the advertiser network is shown only to users over 18 years old. Fanómeno does not accept advertising for betting or alcoholic beverages.

Some features may be offered in exchange for watching rewarded ads. We do not guarantee the permanent availability of such ads or any particular number of them.

The relationship between the user and an advertiser or sponsor with respect to its products, offers or coupons is the sole responsibility of that advertiser. Fanómeno is not responsible for the redemption, validity or conditions of third-party coupons and promotions.

17. Disclaimer of warranties

Fanómeno is offered "as is" and "as available," without warranties of any kind. Because it is in a beta phase, we do not guarantee that the service will be uninterrupted or error-free, or that points, rating, credits, leagues or data will be preserved unchanged. You use the platform at your own risk.

18. Limitation of liability

To the fullest extent permitted by law, Fanómeno shall not be liable for indirect, incidental or consequential damages, or for loss of data, opportunities or profits. In particular, Fanómeno is not liable for the prizes, content or conduct of league creators or other users, or for the loss of points, rating or credits resulting from technical failures, season resets or changes to the service.

19. Indemnification

You agree to hold Fanómeno harmless from any claim, damage or expense (including legal fees) arising from the content you upload, the prizes you offer in your leagues, your breach of these Terms or the infringement of third-party rights.

20. Suspension and termination

We may suspend or terminate your account or a league if you breach these Terms or if necessary to protect the platform or other users. You may stop using Fanómeno and request the deletion of your account at any time; if you do so, you will lose the points, rating, credits and access associated with it.

If you believe that a suspension or a decision on a result is incorrect, you may write to us at soporte@point.fanomeno.com for review.

21. Changes to the Terms

We may modify these Terms to reflect changes to the service or legal changes. We will publish the version in force on this page with its date. Continued use after a change constitutes acceptance of it.

22. Governing law

These Terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the corresponding competent courts, without prejudice to the rights granted to you by law as a consumer.
