1. Who we are

Fanómeno ("Fanómeno," "we," "us") is a gamified sports trivia web platform, with its informational site at fanomeno.com and the game application at play.fanomeno.com. For any matter related to your personal data, you may write to us at privacidad@point.fanomeno.com.

2. What data we collect

Data you provide to us

• Account data: name or username, email address and password.
• Profile data: country, state, city and date of birth, and optionally your photo or avatar.
• Content you upload: images, logos, names and colors you upload when creating or customizing your leagues.
• Communications: messages you send us through support or contact channels.
• Business forms: if you are a brand or a content creator and fill out any of our contact forms, the information you provide there (see section 9).

Data generated through use

• Gameplay data: answers, correct answers, response times, points, streaks, energy and credits, history of games, duels and tournaments, rating and division, leagues you take part in, ranking positions and check-ins.
• Social data: whom you follow, who follows you, your close friends, the challenges you send or receive and your referral code.
• Location data: the approximate location you state in your profile (country, state, city) and, only if you authorize it, your precise location for the in-person check-in of certain leagues (see section 4).
• Advertising data: which ads are shown to you, whether you watch rewarded ads and your interactions with sponsored placements.
• Purchase data: the history of your purchases and subscriptions within the platform (see section 5).
• Technical data: IP address, device and browser type, identifiers and platform usage data.

3. What we use your data for (purposes)

We use your data for the following purposes:

• Operating the game and your account: registering and authenticating you, calculating points, managing your energy and credits and maintaining your progress.
• Competition and matchmaking: calculating your rating and division, and matching you with opponents of a similar level in duels and tournaments.
• Location-based rankings: your country, state and city are used mainly to generate city, state, country and global rankings and standings, and for geographic-affiliation modes.
• Social features: allowing you to follow other players, challenge your friends and see their positions (see section 6).
• Protection of minors and appropriate advertising: your date of birth is used to verify age and apply controls (13+ / 18+), so that underage users are not shown advertising or content unsuitable for them (for example, alcohol, gambling/betting or other sensitive categories).
• Ad personalization and targeting: showing sponsored placements and advertising targeted by age, sport or league, always within a safe environment and respecting age controls.
• Processing payments: managing purchases of credits, league plans and subscriptions (see section 5).
• Communication: notifying you of changes, league news or support matters.
• Security and competitive integrity: protecting accounts, detecting cheating, multiple accounts and collusion, and maintaining the validity of rankings.
• Service improvement: understanding how the platform is used in order to improve it, especially during the beta phase.

4. Location and in-person check-in

We distinguish between two types of location data:

• Declared location (country, state and city): you provide it in your profile and it is used for geographic rankings. It is not your real-time location.
• Precise device location: some leagues or promotions offer in-person check-in via QR code and location verification. This feature is voluntary and requires you to grant location permission in your browser or device. We use it only at the moment of check-in, to confirm that you are at the venue of the league or promotion; we do not track your location continuously or in the background.

You may revoke location permission at any time from your browser or device settings. If you do, you can continue using Fanómeno normally, but you will not be able to take part in leagues or promotions that require in-person check-in.

5. Payments and subscriptions

When you buy credits or sign up for a league plan or a subscription, the charge is made through a third-party payment processor. Your card details are entered into and processed directly by that processor in accordance with its own policies.

Fanómeno does not store your full card number or its security code. We retain only the information necessary to manage your account and comply with legal and accounting obligations: the record of the purchase or subscription, its amount, its date, its status and a transaction identifier.

6. Public profile, rankings and social features

Fanómeno is a competitive and social platform, so part of your information is visible to other users. Specifically, the following may be seen:

• Your username and avatar.
• Your position, points, rating and division in the leaderboards in which you participate.
• Your city, state or country when you appear in the corresponding geographic rankings.
• Your participation and results in the leagues, duels and tournaments in which you compete.

Your email address, password and date of birth are never shown to other users. We recommend choosing a username by which you are comfortable being publicly identified.

7. Minors

Fanómeno is designed to maintain a safe ("brand-safe") environment: it is not a betting site and contains no real-money gambling content. The minimum age to use the platform is 13 years old. Certain content, advertising or leagues may be restricted to people over 18 years old; in particular, advertising from the advertiser network is shown only to people over 18.

We ask for your date of birth precisely to identify minors and prevent them from receiving unsuitable advertising or content. If you are a minor, you must have the consent of your mother, father or guardian. If you believe that a minor has provided us with data without proper authorization, contact us and we will delete it.

8. Content you upload to your leagues

If you create or manage a league, you may upload images, logos and other materials. You are responsible for that content. We process it only to display it within your league. The processing and lawfulness of that content are also governed by our Terms and Conditions.

9. Forms for brands and creators

On fanomeno.com we offer contact forms for brands and advertisers and for creators and communities. If you fill out either of them, we collect the information you provide (for example, the name of the company or project, contact name, email address, phone number, country, city and any business information you choose to share).

We use that information exclusively to contact you and prepare a business proposal. It is not used for third-party advertising and is not sold. You may ask us at any time to delete your request by writing to privacidad@point.fanomeno.com.

Abuse prevention: to prevent automated submissions, these forms include an anti-bot check that runs in your browser and is hosted on our own servers, with no third-party services. In addition, together with your request we store an encrypted fingerprint (hash) of your IP address, which does not allow the original IP to be recovered, in order to limit the number of submissions from the same connection. The log of submission attempts is automatically deleted after three days.

10. Whom we share your data with

• Other users: your public profile information and your results, as described in section 6.
• League creators (businesses, brands, content creators): when you take part in their league, they can see participation data such as your username, points and position. We do not share your email address or password with them.
• Sponsors and advertisers: they receive aggregated or statistical data (for example, how many people viewed or answered a piece of sponsored content), not data that directly identifies you, unless you authorize it when redeeming a coupon or promotion.
• Payment processors: the data needed to charge for your purchases and subscriptions.
• Technology providers: hosting, database, email and analytics providers, which act on our behalf and under confidentiality obligations.
• Authorities: when required by law.

We do not sell your personal data.

11. Cookies and similar technologies

We use cookies and identifiers to keep you signed in, remember your preferences, measure usage and show relevant advertising. You can manage cookies from your browser settings; some are necessary for the platform to work.

12. Data retention

We retain your data while your account is active and for as long as necessary to fulfill the purposes described and the applicable legal obligations. When it is no longer necessary, we delete or anonymize it.

Please note that, if you delete your account, we may retain in anonymized or aggregated form certain historical records of competitions already held (for example, results of completed tournaments or leagues), so that they cannot be associated with you. Billing records are retained for the periods required by tax law.

13. Your rights

You may request at any time: access to your data, its rectification, its deletion, the restriction of or objection to its processing, and its portability. You may also withdraw your consent where processing is based on it, for example by revoking location permission. To exercise your rights, write to privacidad@point.fanomeno.com.

14. Security

We apply reasonable technical and organizational measures to protect your information. However, since the platform is in a beta phase, no system is completely infallible; we recommend that you use strong passwords and do not share your credentials.

15. International transfers

Your data may be processed on servers located in countries other than your own. In such cases, we adopt appropriate safeguards to protect it.

16. Changes to this Policy

We may update this Policy to reflect service improvements or legal changes. We will publish the version in force on this page with its update date. Continued use of Fanómeno after a change constitutes acceptance of it.
